TutorPakar.com – Terms & Conditions (Students & Tutors)
These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User”), which includes both students/parents and tutors/instructors, and TutorPakar.com (“TutorPakar”, “we”, “our”, or “us”), governing your access to and use of the TutorPakar.com website, platform, services, content, communication systems, payment facilities, and all related features (collectively referred to as the “Platform”). By creating an account, accessing any portion of the Platform, registering for tuition, purchasing video courses, or using any services made available through TutorPakar.com, you acknowledge that you have read, understood, and agreed to be bound by these Terms, which shall apply in full and without limitation. If you do not agree to these Terms, you must immediately discontinue your use of the Platform.
PART A: TERMS & CONDITIONS FOR STUDENTS / PARENTS
1. Eligibility
1.1 To access or use TutorPakar.com, you must be at least eighteen (18) years old and currently residing in Malaysia; provided, however, that individuals under the age of eighteen (18) may use the Platform only with the explicit knowledge, permission, and ongoing supervision of their parent or legal guardian, who hereby agrees to be fully responsible for all actions, decisions, payments, bookings, communications, and consequences arising from the minor’s use of the Platform.
1.2 By continuing to use the Platform, you represent and warrant that all eligibility requirements are satisfied.
2. User Accounts
2.1 Users must create an account in order to access tutoring services, video content, communication features, and other functionalities of the Platform.
2.2 You agree to provide accurate, truthful, complete, and updated information during account creation and throughout your use of the Platform, and you acknowledge that providing false or misleading information constitutes a breach of these Terms.
2.3 You are solely responsible for safeguarding your login credentials, and you acknowledge that any activity conducted under your account—whether performed by you, someone acting on your behalf, or an unauthorised party—shall be deemed your own activity. TutorPakar shall not be held responsible for losses arising from unauthorized access caused by your negligence.
3. Tutoring Services
3.1 TutorPakar.com operates strictly as a platform that enables students and tutors to connect, communicate, schedule, and conduct tutoring sessions, whether online or in-person, while the actual tutoring services are provided independently by the tutors.
3.2 Students and parents are fully responsible for selecting a suitable tutor, agreeing on the subject matter, scheduling sessions, clarifying expectations, and ensuring mutual understanding of the tutoring arrangement. TutorPakar does not guarantee a tutor’s performance or outcome.
3.3 Engagements between tutors and students must remain strictly within the Platform; students and parents must not bypass the Platform to arrange private tuition or conduct direct transactions.
4. Payments, Fees & Refund Policy
4.1 All payments for tutoring services must be made exclusively through the TutorPakar.com Platform. Any payment made outside the Platform is strictly prohibited and constitutes a breach.
4.2 TutorPakar deducts a service fee from each transaction for platform maintenance, administration, and operational coverage.
4.3 All tuition fees paid are strictly non-refundable except One-To-One Tuition, including but not limited to situations where the student changes their mind, becomes unable to attend, is dissatisfied with the session, or experiences technical issues outside the tutor’s control.
4.4 Students or parents must provide a minimum of 7 days’ notice before the next billing cycle if they intend to discontinue classes; failure to provide timely notice will result in charges for the next cycle.
4.5 Tutors receive payments only after TutorPakar processes the transaction in accordance with the platform’s payout schedule.
5. Code of Conduct
5.1 Students must behave respectfully, maintain proper communication, and avoid harassment, discrimination, threats, inappropriate behavior, or violation of any law.
5.2 TutorPakar reserves the right to suspend or terminate access for any user who behaves in a manner deemed inappropriate, harmful, or disruptive.
6. Responsibility for Learning
6.1 Students acknowledge that academic performance depends on personal effort, discipline, and learning habits, and that TutorPakar does not guarantee specific grades, improvements, or academic outcomes.
6.2 TutorPakar is not responsible for a tutor’s teaching style, curriculum choices, or assessment methods.
7. Intellectual Property
7.1 All text, graphics, logos, interfaces, digital products, structures, learning materials, features, and software on the Platform remain the exclusive intellectual property of TutorPakar.
7.2 No user may copy, distribute, download, modify, reuse, or exploit any content without written permission from TutorPakar.
8. Limitation of Liability
8.1 TutorPakar shall not, under any circumstances, be liable for interruptions, errors, data loss, network failures, tutor performance issues, or any damages resulting from use of the Platform.
8.2 You agree that use of the Platform is at your sole risk.
9. Modification of Terms
TutorPakar reserves the right to modify, revise, or update these Terms at any time without prior notice. Continued use of the Platform constitutes acceptance of the updated Terms.
10. Termination
TutorPakar may suspend or terminate your account at any time, for any reason, without notice, including but not limited to misconduct, breach of Terms, or suspicious activity.
11. Severability
If any provision of these Terms is deemed invalid, the remaining provisions shall remain fully enforceable.
12. Entire Agreement
These Terms constitute the full agreement between the student/parent and TutorPakar.com.
PART B: ONE-TO-ONE TUITION TERMS & CONDITIONS
1. Tuition Fees
1.1 Tuition fees are charged hourly and will be communicated before any class is arranged.
1.2 Full payment must be made according to the agreed payment cycle.
2. Refund Policy (Strict)
2.1 Any refund request is subject to the following non-refundable deductions:
- Administrative Fee: 25%
- Tutor Syllabus Research & Preparation Fee: 25%
- Tutor’s Time Allocation Fee: Remaining balance
2.2 After all deductions, only 25% of the eligible remainder may be refunded, and only if advance notice was properly provided. A full refund is strictly not eligible as the tutor has already allocated and reserved the designated time slot specifically for the student, during which the tutor is unable to replace or recover potential students or alternative bookings, resulting in an irreversible loss of opportunity that cannot be compensated once the time has been set aside; each tutor operates with limited teaching capacity, and accepting a booking requires declining other potential students, thereby creating an opportunity cost that cannot be recovered after a booking is confirmed. 2.3 No refunds will be issued for last-minute cancellations, absenteeism without notice, or any instance where the tutor has already allocated time that cannot be recovered.
3. Class Amendments & Cancellations
3.1 Students must give 24-hour advance notice for any changes.
3.2 Excessive last-minute changes may result in discontinued service.
4. Tutor Commitment
4.1 Tutors will prepare materials based on the agreed syllabus.
4.2 If a tutor is unable to attend, a replacement class or refund for that session will be arranged.
5. Student/Parent Responsibility
5.1 Students must attend punctually and be prepared.
5.2 Parents must ensure accurate contact and billing details.
6. Acceptance of Terms
By enrolling in tutoring services, the student/parent agrees to all terms in this section.
PART C: TERMS & CONDITIONS FOR TUTORS / INSTRUCTORS
1. Introduction
By registering as a tutor on TutorPakar.com, you acknowledge and agree that these Terms govern your use of the Platform and form a legally binding agreement between you and TutorPakar.
2. Tutor Content & Videos
2.1 You represent that all videos, materials, and content uploaded are your original work and do not infringe upon any third-party rights.
2.2 TutorPakar shall not be held liable for infringement caused by your content.
3. Responsibilities & Conduct
3.1 You acknowledge that you alone are responsible for the legality, accuracy, copyright ownership, and consequences of all content you upload.
3.2 You strictly must not initiate personal communication with students outside the Platform, including WhatsApp, social media, calls, SMS, or email.
3.3 Breach of this rule will result in a penalty equal to ten (10) times the total amount received by the tutor from the student.
3.4 All communication must be conducted through the designated in-platform messaging system.
4. Intellectual Property License
By uploading content, you grant TutorPakar a worldwide, royalty-free, transferable, sublicensable license to store, reproduce, modify, distribute, and display your content for platform purposes.
5. Prohibited Content
You must not upload content that contains hate speech, discrimination, pornography, sexual content, violence, misinformation, illegal activity, or harmful elements. TutorPakar may remove such content without notice.
6. Transactions & Payments
6.1 TutorPakar retains 25% of all video-course sales as a service and processing fee.
6.2 The remaining 75% will be transferred to your provided bank account.
6.3 You are solely responsible for ensuring accurate banking information.
7. Termination
TutorPakar may terminate your account or remove your videos at any time without notice.
8. Disclaimer of Warranties
TutorPakar makes no guarantees regarding accuracy, reliability, or outcomes of tutor-provided content.
9. Limitation of Liability
Under no circumstances shall TutorPakar be liable for direct, indirect, or consequential damages arising from your participation as a tutor.
10. Governing Law
These Terms shall be governed by the laws of Malaysia.
11. Changes to Terms
TutorPakar may update these Terms without notice; continued use indicates acceptance.
12. Entire Agreement
These Terms form the complete agreement between the tutor and TutorPakar.com.
