For students
1. Eligibility:
You must be at least 18 years old and reside in Malaysia to use TutorPakar.com. If you are under 18 years old, you must obtain the consent of your parent or legal guardian to use the platform.
2. User Accounts:
To use TutorPakar.com, you must create a user account. You must provide accurate and complete information when creating your user account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your user account.
3. Tutoring Services:
TutorPakar.com provides an online platform for tutors and students to connect and arrange tutoring services. You are responsible for selecting a tutor and agreeing to the terms of the tutoring services, including the subject matter, schedule, and payment.
4. Payments:
You must pay for tutoring services through the TutorPakar.com platform. TutorPakar.com will deduct a service fee from each payment made by you. Tutors will receive payment for their services through the TutorPakar.com platform. All fees paid for tuition registered and offered by TutorPakar.com are non-refundable. Once you have paid for a course or tutoring session, we cannot provide a refund for any reason. This includes, but is not limited to, cases where you are unable to attend a scheduled session, or if you are dissatisfied with the services provided.
5. Code of Conduct:
Tutors must conduct themselves professionally and ethically when providing tutoring services through TutorPakar.com. Tutors must not engage in any discriminatory or harassing behavior or violate any laws or regulations.
6. Responsibility for Learning:
You are responsible for your own learning and academic performance. TutorPakar.com does not guarantee any specific results or outcomes from using the platform or the services provided by tutors.
7. Intellectual Property:
TutorPakar.com owns all intellectual property rights in the platform and its contents. You may not use any content from TutorPakar.com without the express written permission of TutorPakar.com.
8. Limitation of Liability:
TutorPakar.com is not liable for any damages arising from your use of the platform or the services provided by tutors. TutorPakar.com is not responsible for any losses or damages resulting from any errors or interruptions in the platform or its services.
9. Modification:
TutorPakar.com may modify these Terms and Conditions at any time. You are responsible for reviewing these Terms and Conditions regularly to ensure that you are aware of any changes.
10. Termination:
TutorPakar.com may terminate your access to the platform at any time for any reason, without notice.
11. Severability:
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
12. Entire Agreement:
These Terms and Conditions constitute the entire agreement between you and TutorPakar.com with respect to your use of the platform and supersede all prior or contemporaneous communications and proposals, whether oral or written.
For tutors / instructors
1. Introduction
These terms and conditions (“Terms”) govern your use of the services provided by TutorPakar.com (“TutorPakar” or “we”) as a tutor on our platform. By using TutorPakar.com, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our platform.
2. Your Videos
As a tutor on TutorPakar.com, you represent and warrant that any content you upload to our platform, including your videos, is your original work and does not infringe upon any third-party intellectual property rights. You understand and acknowledge that TutorPakar.com will not be held liable for any infringement of third-party intellectual property rights by your videos.
3. Responsibility
You are solely responsible for any content that you upload to TutorPakar.com, including your videos. You acknowledge and agree that TutorPakar.com will not be held liable for any damages or losses incurred as a result of any third-party infringement of your videos or any other illegal activity related to your use of our platform. By using TutorPakar.com as a tutor, you agree not to initiate personal communication with students outside of the platform, including through phone calls, emails, or social media. Any violation of this policy will result in strict consequences, including a penalty of ten times the amount received by the tutor. This measure is implemented to ensure the safety, privacy, and integrity of the TutorPakar.com community. Please note that all communication should be conducted solely through the platform’s designated messaging system. By registering as a tutor, you acknowledge and accept these terms and conditions.
4. Intellectual Property
By uploading your videos to TutorPakar.com, you grant TutorPakar.com a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, modify, reproduce, distribute, and display your videos on our platform. You represent and warrant that you have all necessary rights and licenses to grant such a license to TutorPakar.com.
5. Prohibited Content
You must not upload any content to TutorPakar.com that contains or promotes hate speech, discriminatory language, pornography, sexually explicit content, illegal activities, violence, or misinformation. We reserve the right to remove any content that violates this provision or any other provision of these Terms.
6. Transactions and Payment
TutorPakar.com will take away 25% of each transaction made for your video courses sold on our platform. You acknowledge and agree that the remaining 75% will be transferred to your bank account provided by you. It is your responsibility to ensure that the bank account information you provide is accurate. TutorPakar.com will not bear any losses resulting from inaccurate bank account information provided by you.
7. Termination
TutorPakar.com reserves the right to terminate your account and remove your videos at any time, for any reason, without notice. You understand and acknowledge that TutorPakar.com will not be held liable for any damages or losses incurred as a result of such termination.
8. Disclaimer of Warranties
TutorPakar.com makes no warranties or representations about the accuracy, reliability, completeness, or timeliness of the content uploaded by tutors on our platform. We do not endorse any views expressed in the content and disclaim all liability in connection with any content uploaded by tutors.
9. Limitation of Liability
To the maximum extent permitted by law, TutorPakar.com shall not be liable for any direct, indirect, special, consequential, or punitive damages arising out of or in connection with your use of our platform, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses.
10. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Malaysia. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
11. Changes to the Terms
TutorPakar.com reserves the right to modify these Terms at any time, without notice. Your continued use of our platform after such modifications shall constitute your acceptance of the modified Terms. It is your responsibility to review these Terms periodically to ensure that you are aware of any changes.
12. Entire Agreement
These Terms constitute the entire agreement between you and TutorPakar.com with respect to your use of our platform and supersedes all prior agreements, representations, and understandings, whether written or oral.
By using TutorPakar.com, you agree to abide by these Terms and Conditions. If you do not agree to these Terms and Conditions, you must not use TutorPakar.com.
